San Juan County DUI Records

San Juan County is one of Utah's largest counties by land area but one of the smallest by population. The county seat is Monticello. Other communities include Blanding, Bluff, and Mexican Hat. Each sits along a major state or federal highway, and DUI enforcement on those roads produces arrests that feed into the county's DUI records system.

DUI records in San Juan County are created at multiple points. The arresting agency files an initial report. That report must reach the Utah Driver License Division within five workdays. The DLD opens an Administrative Per Se file. The 7th District Court opens a criminal case file once charges are filed. Each of these documents is a separate record, held by a separate agency. Getting the full picture of a DUI case in San Juan County may require contacts with more than one office.

The Utah Commission on Criminal and Juvenile Justice publishes annual statewide DUI data. Utah recorded 10,923 DUI arrests in fiscal year 2025 across all counties. San Juan County's remote location and sparse population mean its case numbers are low in total but spread across a wide area.

Note: Due to the county's geographic size, some San Juan County DUI arrests happen far from Monticello. Court records are still filed centrally with the 7th District Court.

Utah DUI Laws in San Juan County

Utah's DUI laws apply uniformly across all 29 counties, including San Juan County. The legal blood alcohol limit is .05 under Utah Code section 41-6a-502. Utah was the first state in the country to adopt this lower threshold. A driver on any San Juan County road can be charged with DUI at .05 BAC, which is lower than the .08 limit most drivers know from other states.

The metabolite DUI law under Utah Code section 41-6a-517 also applies in San Juan County. A person can be charged with DUI for having any measurable amount of a controlled substance metabolite in their body, even if the substance was used days earlier and the driver shows no signs of impairment. This is one of the strictest drug-DUI rules in the country.

Implied consent under Utah Code section 41-6a-520 means every driver on San Juan County roads automatically agrees to chemical testing when arrested for DUI. Refusing the test results in an automatic license suspension: 18 months for a first refusal and 36 months for any repeat refusal. DUI in Utah is a strict liability offense. A guilty or no-contest plea goes directly on the record without the option to hold the case in abeyance. First-offense penalties under Utah Code section 41-6a-505 include a minimum $700 fine and jail time along with an ignition interlock device requirement. Utah also shares DUI conviction data with all other states and Canadian provinces through interstate compacts.

License Actions and IID Requirements

A DUI arrest in San Juan County triggers two parallel processes. The criminal case goes to the 7th District Court. The administrative license action goes to the Utah DLD. Both can result in penalties, and neither waits for the other to conclude first.

The DLD receives DUI reports from San Juan County law enforcement within five workdays. Once received, the DLD initiates an Administrative Per Se suspension. Drivers must act quickly to request a hearing and challenge the suspension. The window for requesting a hearing is limited.

Ignition interlock device requirements follow Utah's statewide schedule regardless of which county the arrest occurred in. A first DUI conviction requires an IID for 18 months. Drivers under 21 on a first offense face a three-year IID period. A second DUI conviction results in a three-year IID requirement. A felony DUI carries a six-year IID requirement. Auto homicide involving DUI results in a 10-year IID requirement. Approved IID providers are listed at dld.utah.gov/iid.

Note: A San Juan County resident convicted of DUI must complete the IID period before returning to unrestricted driving. The requirement applies statewide, not just in San Juan County.
